Oral Arguments Scheduled In FDA Appeal of Premium Cigar Lawsuit
WASHINGTON, D.C. (July 15, 2024) – Today, the U.S Court of Appeals for the District of Columbia announced the scheduling of oral arguments in the ongoing legal battle between the premium cigar industry and the United States Food and Drug Administration.
As of today, oral arguments are set to take place on Friday, September 13, 2024, at 9:30 a.m. The case, Cigar Association of America et al. v. United States Food and Drug Administration et al., (CAA et al. v FDA) has been in litigation for eight years, challenging the FDA's regulation of premium cigars.
To refresh reader’s minds: on August 9, 2023, Judge Amit Mehta issued a ruling in the CRA-led lawsuit CAA et al. v FDA, striking down all FDA regulations on premium cigars. On January 31, 2024, FDA filed its initial brief in the case, providing a detailed enumeration of the substantive grounds upon which FDA is basing its appeal of Judge Mehta's decision. On April 15, 2024, CRA filed our initial reply brief on behalf of the industry. On May 23, 2024 FDA filed their response to the industry reply brief.
CRA and our legal counsel remain steadfast in our confidence regarding the soundness of Judge Mehta's decision.
