California Approves Emergency UTL Regulations

We wanted to provide you with an update regarding the implementation of the regulations regarding the Unflavored Tobacco List (UTL) in California.
Late yesterday, August 25, 2025, the Office of Administrative Law approved the California Department of Justice’s emergency regulatory proposal to administer and maintain the UTL.
As such, manufacturers and importers will have 45 days from that date (October 9, 2025) to submit their products for inclusion on the UTL. To access the UTL website, click here.
CRA’s regulatory attorneys are preparing an updated memorandum analyzing the final regulations and will be making it available to affected stakeholders as soon as it is ready and provide a general analysis of its findings regarding some outstanding ambiguities which our team is exploring.
